چالش‌های اخلاقی و حقوقی گردشگری سلامت

چکیده

اخلاق و حقوق مهم‌ترین رکن توسعه هر بخش به شمار می‌آیند، به‌­ویژه وقتی توسعه در ابعاد بین­المللی و در حوزه حیاتی سلامت و پزشکی مطرح باشد.به‌رغم رشد سریع گردشگری پزشکی، این صنعت با چالش­های جدی حقوقی و اخلاقی مواجه است. از مهم‌ترین مسائل حقوق مربوط به گردشگری سلامت و پزشکی می‌توان به دسترسی به خدمات، بیمه سلامت، اعطای مجوز و مجوزهای لازم قانونی مراکز ارائه‌دهنده خدمات مراقبت‌های سلامت بین‌الملل اشاره کرد. مسائل و چالش‌‌های حقوقی متعددی در حوزه توریسم پزشکی مطرح است که در صورت حل نشدن، می‌توانند موانع جدی در شکل‌گیری و توسعه آن ایجاد کنند.  با توجه به ماهیت گردشگری پزشکی، به منظور حل و فصل مسائل اخلاقی و حقوق، قبل از هر چیز لازم است قوانین و مقررات متناسب با سطح بین‌المللی اصلاح شوند و استانداردهای لازم به درستی در متن قوانین تبیین شوند. حفظ اعتماد بیماران به منظور انتخاب یک مرکز ارائه‌دهنده خدمات کسب و گردشگری پزشکی، به رعایت استانداردهای کیفی و ایمنی بستگی دارد. سپس، لازم است نظارت قانونی لازم برای اطمینان از اجرای قوانین و مقررات و رعایت استانداردها به عمل آید و در کنار آن، بیمه بین‌المللی کافی، این خدمات را تحت پوشش قرار دهد.

چکیده [English]

Ethics and law are the most important pillars of development for any sector, Especially when it comes to development at international levels and in the vital field of health and medicine.
Despite the rapid growth of medical tourism, this industry faces serious legal and ethical challenges. The most important issues related to health and medical tourism rights are access to services, health insurance, licensing and legal licenses of international health care service providers. There are a number of legal issues and challenges in the field of medical tourism that, if left unresolved, could pose serious obstacles to its formation and development. Given the nature of medical tourism, in order to resolve ethical and legal issues, it is first of all necessary to amend the laws and regulations in accordance with the international level and to explain the necessary standards correctly in the text of the laws. Maintaining the trust of patients in order to choose a center that provides medical business and tourism services depends on compliance with quality and safety standards. Then, it is necessary to provide the necessary legal supervision to ensure the implementation of laws and regulations and compliance with standards, and at the same time, adequate international insurance to cover these services.
