بررسی فقهی استحاله

چکیده

از جمله مطهراتی که اجماع بر طهارت پس از حصول آن شکل گرفته، استحاله می‌باشد که فقهاء علت آن را تبدّل موضوع حکم شرعی دانسته‌اند. در مقاله‌ی حاضر به تعریف و میزان استحاله پرداختیم و تشریح کردیم که استحاله در باب نجاسات و متنجسات، در زبان شریعت به عنوان مطهر نیامده و مسأله‌ای عرفی و مورد تأیید شارع می‌باشد. در تعریف بیان شد: «استحاله یعنی تغییر حقیقت عرفی یک چیز نجس یا متنجس به عنوان و چیز دیگری که طهارت واقعی یا ظاهری دارد». اگر عرف حقیقت یک چیز را تغییر کرده بداند، استحاله تحقق پیدا کرده است. سپس مفاهیم شبیه به استحاله همچون «انقلاب» و «استهلاک» را بررسی کردیم تا تفاوت آن با استحاله روشن شود. همچنین موارد شک در تحقق این مطهر را بررسی نمودیم که اجرای استصحاب نجاست، به خاطر شرط بقاء موضع، شک در مقتضی و کلی بودن حکم محل تأمل است و باید به قاعده‌ی طهارت تمسک نمود که در نمونه‌های ذکرشده از فتاوا، این مسائل مورد لحاظ قرار گرفته است.

چکیده [English]

Transformation(Istihalah) is one of the purifiers that there is a consensus among jurists on it.  The reason is metamorphosing the issue of religious law into another. In this paper, we will define the meaning of the transformation and explain that it has not come from the Shari'ah but from the Convention(o'rf). The definition states: "Transformation means the change of an impure thing into something that has real or apparent purity customarily". Then we will examine concepts such as "metamorphosis" and "sublation" to clarify their differences with transformation. We will also take a look at the cases of doubt in the realization of transformation(Istihalah) and discuss in some examples and Fatwas about the differences between the Rule of Purity and the transformation(Istihalah).
